In our country it is estimated that three out of every four children of separated parents do not receive alimony in due time and form, on many occasions it is likely that these defaulters declare a lower salary than they actually receive or do not report any income with such to evade obligation. So here we tell you what the initiative proposed by the Senator of the Morena parliamentary group, Nancy Guadalupe Sánchez, is that goes against parents who do not comply with alimony.

In this sense, the Senator of the Morena bench, raises an initiative that aims to create a « National Registry of Debtors Alimony Delinquent » for parents who do not comply with their obligations to pay alimony for more than 90 days .

Said approach was published in the Gazette of the Permanent Commission of the Congress of the Union on January 13, 2021, which has the objective that the judges in family matters of the States of the Mexican Republic have the power to instruct the registration of the data of parents who do not comply with their obligation in time and form the provisional or definitive pension established by resolution or judicial agreement.

The initiative also requires that non-compliant parents be applied a fine of 10 to 50 days of minimum wage, who for more than 180 days of registration in the National Registry, have not updated their situation.

In addition, the Senator said that another of the benefits of the database is to prevent them from getting married, in the event that some of the parents are registered as debtor of the payment of alimony. And he added that the modifications to the Federal Civil Code have the objective of giving attention above all things, to girls and boys, with the implementation of effective policies that provide protection and promote the development of infants and adolescents in Mexico.

Alimony is a right granted by law in our country to the children of parents who are separated. Said right consists in that every fortnight or month, a certain amount of money must be deposited or transferred to the father or mother who is in charge of the minors. Alimony needs consist of: food, clothing, footwear, education , entertainment, supplies required at school and everything related to the health of the parent.

The time for granting alimony will be until the minors reach the age of majority, which is 18 years, except in some cases that could be up to 21 years, in case the children were studying at the university.

Parents have the obligation to feed their children. In case the parents are disabled, this obligation is for the ascendants by the two closest parties.

Alimony can be requested through a complaint in a family court, however, it is not always the father or mother who makes said complaint, since another relative could make the custody of the child, or in some cases even the public prosecutor

Some of the documents that are required to make the application for alimony are: birth certificate of the children who are minors, complaint before the corresponding courts, list of expenses that refer to the needs of the children.
